Cashar Posted June 6, 2021 Share Posted June 6, 2021 Establishment of the Republic of Cashar  We, the people of the new Republic of Cashar, on this day the 17th of July in the year 1770 seek to establish a more unified nation dedicated to the wealth, prosperity, and welfare of its citizens. We hold the right to independent governance of a stable nation to be natural and good to the cause of humanity itself. Such stability has been accomplished accordingly in the Republic of Cashar through the actions of independent states working together for the common good. We claim the nation of the Republic of Cashar to include the following states: Centavo, Rabal, Danir, Shakel, Qindrak, Sostynak, Nykel, Kyatlek, Marka, Krona, Drakam, and Bitkan. Section 1 1. Cashar is hereby established as a democratic republic, subject to the rule of law, which advocates for prosperity, freedom, and justice. 2. National sovereignty belongs to the Cashari people, from whom all state powers emanate. 3. The political form of the Republic of Cashar is a parliamentary republic. Section 2 The Constitution is based on the peaceful coexistence and agreement of Cashar's twelve unique states. Each state has the right to self-governance and the right to a representative in the Republic of Cashar as a whole. Section 3 1. The official language of Cashar is Monetok. All Cashari have the duty and the right to know it and use it. Other languages in Cashar are recognized as official in their respective communities, and no Cashari shall be punished for the use of a language that is not Monetok. Section 4 The flag of Cashar consists of the colors green, gold, and silver. Each of the twelve states shall be represented by a star. Chevrons will be present in order to represent Cashar's progress moving forward. Section 5 The capital city of the Republic of Cashar shall be Protiva in the state of Centavo. Section 6 Political parties contribute to the formation and expression of the will of the people. Their creation and activities are free in so far as they respect the Constitution and the law. Section 7 Privately-owned businesses contribute to the defense and promotion of economic interests. Their creation and the exercise of their activities shall be free in so far as they respect the Constitution and the law. Section 8 The mission of the Armed Forces is to guarantee the sovereignty and independence of the Republic of Cashar and to defend its territorial integrity and economic interests. Section 9 Citizens and public authorities are bound by the Constitution and all other legal provisions. Part I: Rights and Duties Chapter 1: Basic Cashari Rights  1. No person of Cashari birth shall be deprived of his, her, or their nationality. 2. Every citizen, no matter their gender identity, religious expression, or economic status, from the time literacy is achieved and onwards has the right to vote. 3. Every citizen, no matter their gender identity, religious expression, or economic status, from the time literacy is achieved and onwards has the right to work. 4. No person of Cashari or foreign birth shall be subjected to torture or cruel and inhumane punishment nor shall they be subject to slavery. 5. Every citizen, no matter their gender identity, religious expression, or economic status, has the right to spend their wages as they see fit. 6. There is no official religion of the Republic of Cashar. Citizens are free to practice any religion or no religion as they see fit. 7. No person of Cashari or foreign birth shall be put to death as punishment for crime. 8. Every citizen has the right to move freely within the country and to take up residence where they wish. 9. Freedom of speech is considered sacrosanct in so far as it does not cause disturbance or distress in government or the general public. Chapter 2: Conscription 1. Able-bodied adults not currently enrolled in educational courses or possessing an exemption must participate in mandatory two-year conscription in service of the Republic of Cashar. 2. Exemptions may be had for people of disability, for those enrolled in educational courses, for those who are able to pay the military service fee, or for those who can prove religious obligations. 3. The military service fee is to be set by the Legislature. Chapter 3: Governing Principles of Economic Policy 1. The people of the Republic of Cashar are to be allowed freedom from taxation without representation. 2. The public authorities shall promote favorable conditions for economic progress. They shall in particular carry out a policy aimed at full employment. 3. The law shall ensure minimal regulation of the professional organizations which contribute to the defense of their own economic interests. Their internal structure and functioning must be democratic. Part II: The Government Chapter 1: The Head of the Republic 1. The Head of the Republic is the free leader of the Republic of Cashar and a symbol of its unity and permanence. He, she, or they exercises the functions expressly conferred by the Constitution and the laws. 2. The Head of the Republic shall be chosen through popularity vote in a democratic election process. 3. On being elected, the Head of the Republic shall swear on their life or respective Higher Power to obey the Constitution and the laws and to respect the rights of citizens and the self-governance of the states. 4. The Head of the Republic shall sanction and promulgate the laws. 5. The Head of the Republic shall summon and dissolve the Parliament and call for elections under the terms provided by the Constitution. 6. The Head of the Republic shall be informed of the affairs of the Republic of Cashar at both the national and international stage. 7. The Head of the Republic shall exercise supreme command over the Armed Forces. 8. The Head of the Republic accredits ambassadors and other diplomatic representatives. Foreign representatives in the Republic of Cashar are accredited before them. 9. The Head of the Republic shall receive a salary to be determined by the Parliament. Chapter 2: The Parliament 1. The Parliament represent the Cashari people and shall consist of the Board and the Bureau. 2. The Parliament shall exercise the legislative power of the State and adopt its Budget, control the action of the government, and have the other competencies assigned by the Constitution. 3. The Parliament are inviolable. 4. The Board shall consist of one democratically elected member from each state. 5. Only Cashari of means and full legal education as well as full exercise of their political rights shall be electors and may be elected. 6. The Board is elected for six years. The terms of office of Members therefore ends six years after their election or on the day which the Board is dissolved. 7. The Bureau shall be elected by proportional representation of the populations of the States. 8. The Members of the Bureau are elected for four years. The terms of office of Members therefore ends four years after their election or on the day which the Bureau is dissolved. 9. Members of the Board and Bureau may receive a salary to be determined by the Head of the Republic. 10. The Parliament lay down their own Standing Orders, adopt their budgets autonomously and by common agreement. The Standing Orders and their reform shall be subject to final vote by an overall majority. 11. The Parliament shall meet annually for two ordinary periods of sessions. 12. The Parliament may meet in extraordinary sessions at the request of the Head of the Republic or due to extraordinary circumstances of domestic or foreign affairs. Extraordinary sessions must be convened with a specific agenda. 13. The Parliament may appoint inquiry committees in matters of public or economic interest. 14. The Bureau may receive individual and collective petitions, always in writing. 15. The Bureau may refer these petitions to the Board and the Head of the Republic. 16. Legislative delegation must be granted by means of act of basic principles when its purpose is to draw up texts in sections, or by an ordinary act when it is a matter of consolidating several legal statutes into one. 17. The acts of basic principles may in no case: authorize the modification of the act itself or grant power to enact retroactive regulations. 18. The Head of the Republic must sign off on enacted laws and regulations before they are given precedent. Chapter 3: The Paramount Court 1. Justice emanates from the people and is administered by judges and magistrates members of the Paramount Court who shall be independent, shall have fixity of tenure, shall be accountable for their acts and subject only to the rule of law. 2. Judges and magistrates may only be dismissed, suspended, transferred or retired on the grounds and subject to the safeguards provided for by the law. 3. The exercise of judicial authority in any kind of action, both in ruling and having judgments executed, is vested exclusively in the courts and tribunals laid down by the law, in accordance with the rules of jurisdiction and procedure which may be established therein. 4. It is compulsory to comply with sentences and other final resolutions of judges and courts, as well as to pay them such assistance as they may require in the course of trials and for the execution of judgments. 5. The Paramount Court shall consist of the Director of Courts, who shall preside it, and of twelve justices appointed by the Head of the Republic for a five-year period. 2 Link to comment
