Law of the Sea Convention

As far as I can tell, the arrivals are still open. So I'll be hopping onto the dock like it's still the same day. This story takes place in the past (1959) so we can play around with how time works.

@Faramount Since you are the game master of this RP, you get to uphold the rules and timings.

Regarding players who join late: it's common practice to reply with a "Space reserved" if they wish to post their participation later.

@Rihan Likewise. 🙂 It's been a while since the last time I could join a RP.

@Andalla @Sunset Sea Islands I do hope I got the dates right of the Thalassan War. Some years are mentioned in the RP, other in Andalla's dispatches and Sunset's IIWiki. If not then I'll edit.

We've still got the arrivals open right now, I believe. But even once we get into talks, I don't think it'd be prohibited for nations to join. They could simply RP their arrival, and first contribution to negotiations, in the same post.

When do we think we should move onto the proper negotiations?

As much as I don't want to, I think I'm going to have to bow out of participating in this. I don't have as much time as I would want to do devote to present Europa, let alone Past Europa.

Is it too late to join?
And LF didn't exist at this time, so is it ok if I send multiple envoys from multiple of the nations that now comprise LF? I'd write them all in one post. It's fine if I can't then I'll only send one from one of the nations.

I'd run into the problem that the real life law of the sea relied heavily upon the UN, IMO, and existing maritime law. So in addition to trying to simplify things, I also had to try to create a framework in which the convention could operate.

I'll be putting up an IC post in the next few days kicking off the substantive talks. But I wanted to summarize OOCly exactly what each document does.

The International Maritime Convention:

  • Uses a simplified system of establishing coastal baselines. (Article I)
    • These baselines generally are just lines marking the coast.
    • But our system of baselines is really in favor of the coastal state (unlike IRL, where there's a balance) to simplify things.
  • Divides the waters of the world into five categories:
    • Internal Waters. (Article II)
      • Located on landwards side of baseline.
      • State has total sovereignty, but is bound by environmental rules.
    • Territorial Waters. (Article II)
      • 0-12 nautical miles out from baseline.
      • State has total sovereignty, but is bound by environmental rules and innocent passage rules.
    • Contiguous Waters. (Article II)
      • 12-24 nautical miles out from baseline.
      • Technically part of international waters.
      • State can exercise the powers necessary to prevent/punish violations in its territorial/internal waters of its customs, fiscal, immigration, environmental, or sanitary laws and regulations within its territory and territorial waters.
    • Economic Waters (Article IV)
      • 12-200 nautical miles from baseline (except that it can extend out to 350 nautical miles if continental shelf extends so far).
      • Technically part of international waters.
      • State has exclusive rights over fishing, mining, and other uses of sea resources.
      • State can enforce some safety and environmental regulations.
    • International Waters (Article V)
      • Everything 12+ nautical miles beyond baseline.
      • Except to the extent that it is also contiguous/economic waters, no nation can exercise authority here.
  • Authorizes innocent passage through territorial waters. (Article III).
    • Any ship can innocently pass, except that a state can prohibit the innocent passage of tankers, nuclear-powered vessels, and/or vessels carrying nuclear weapons and other environmentally hazardous cargos.
    • Warships can innocently pass, but must surface (if submersible) and not engage in weapons activities.
    • States can impose some general safety/environmental regulations on innocent passage, but innocently passing ships must otherwise be unmolested.
    • Generally, the law of the flag state applies onboard an innocently passing ship, though there are exceptions.
  • Creates some basic regulations for international waters (Article V).
    • States must require their ships to obey certain safety/environmental regulations.
    • Creates a duty of ships to render aid to distressed ships.
  • Prohibits piracy and unauthorized broadcasting (Article VI).
    • Authorizes any state to enforce these prohibitions in international waters.
    • Authorizes visitation of ships to enforce, and hot pursuit through waters of other states.
  • Requires states to adopt certain environmental laws/regulations (Article VII).
    • Generally, states are supposed to preventing their peoples from polluting the marine environment.
    • This is mostly toothless, but could create a legal claim by one state against another for pollution causing damage to the other.
  • Grants the International Maritime Court jurisdiction of disputes over the convention (Article 63).

The First Optional Protocol bans the maritime slave trade. The Second Optional Protocol bans the maritime drug trade.

The Statute of the International Maritime Organization:

  • Creates the IMO, comprised of an assembly and a secretariat.
  • Every nation has one vote in the assembly, which has the principle job of developing international maritime law, but also sets the budget and policies of the organization.
  • The assembly appoints the Secretary General, who employs the other members of the Secretariat. The statute does designate the first secretary general (we'll need to decide that).

The Statute of the International Maritime Court:

  • Creates the IMC, which has jurisdiction of maritime disputes between nations. To hear a case, either a treaty must provide for it (as the international maritime convention does) or all of the parties to the dispute must agree to it.
  • A state can grant the IMC compulsory jurisdiction over maritime disputes, meaning that the court could force the state to resolve the case before the court. This grant is revocable.
  • The court decides disputes based on treaties, customary international law, general principles of international law, and other relevant materials.
  • The Organization oversees the administration of the IMC and appoints its judges.

Whilst I'm not a member of the actual convention, I imagine I can retroactively be a signatory, if at a later date than the RP takes place at?

Thank you very much! 

Any nation can accede to the convention once it takes effect. So, essentially, your country would just have to file a notice saying "we accede to this," and you'd join.

I imagine once the conference is done, we could setup a thread in diplomacy for the administration of it, and then you could do like a back-dated post acceding to the convention if the RP powers are okay with it.

It could be done sometime after the thread?

I've seen a couple of nations who weren't in the Laren Environmental Conference have ratified the convention after the fact.

So continuing my necromancy for the day, I figured I'd revive this topic. We left off with the start of substantive negotiations. I detailed here the controversial points of the treaty.

If nobody's nation objects to those points, then we can just skip ahead to the signing, and I can get to work on the wiki page.

I have no problems with what's there.  Wonder if this would impact the Keelpijp - @Variota your thoughts?

      So the OOC thread is here and I'm going to take my time here to explain exactly what I'd want to happen.
      What is Ceris?
      Ceris is the large island west of the island of Seylos and south of Derthalen. It's a complicated placed populated by a variety of nations and peoples. It's defining features are that of a poor and unstable place with frequent conflict between these nations. It is also home to the Ceriser culture, a rugged group of people formed long ago after Anglish, Alban, Cymrian, and Germanic cultures intertwined while settling the land. Below the surface, a forgotten threat has already begun to sink its teeth into the societies of Ceris.
      Who Are the Sentists?
      The Sentists were a radical cult formed over a year ago and made their appearance in the Dolch See Halloween RP. The nations of @Seylos, @Fulgistan, and Adaptus engaged with the mysterious seafaring pirates on the open ocean only for them to disappear again. The only thing known of their faith is that they greatly desire to send a message to their diety, whatever that message may be. They've already infested parts of Ceris and have started to sow chaos, though their involvement isn't strictly known just yet.

      Above I've numbered every territory that could make an appearance in RP's about Ceris. Of course not every one of them needs to make it into the RP or be mentioned at all, but their possibilities are there.       How do I join? Won't this cause war with Seylos if I get involved?
      The majority of the island is of the Ceriser culture, and while distantly related to the main Seylosian cultures, relations between Seylos and these Ceriser countries has been sour. So don't worry! Seylos isn't going to throw a fit (in the beginning at least) over your involvement.
      As for how to get involved, you can get involved any way you see fit! With the exception of countries that have very xenophobic views almost all of them will accept help in whatever form from a country willing to offer it. These nations are on the brink of collapse and social upheaval and in general are very weak. Once your merry band of adventurers (no matter how big that group is ) gets into Ceris they will have free enough reign to move on with your bit in the story. Just don't forget you may get into conflict with another player's vision for that land.
      How will the story progress?
      Through myself. I will be making core story posts for Seylos's own adventure in Ceris and my posts will contain the major events that can effect everyone in the RP simultaneously. However don't let this slow you down, you can effect the world too without my posts.
       
      So if you're interested or have any questions that I can clear up go ahead and make a post. This is a very open ended RP and it's a story we can all build together.

      I was thinking about regional organisations. And the spectrum of sea-based nations came to mind. The working title is GIN: Group of Island Nations. 
      Premise
      We could discuss common socio-economical topics challenges as economic development, trade and shipping, ecology, fishing, and much more. Because there'd probably be some shared problems and solutions there. Different from those other, land-based neighbours. 
      Leadership. From a practical point of view, perhaps rotating leadership role where the Secretary-General changes every 6 months.
      Agenda. The Sec-Gen is responsible for organising a conference on 1 topic. That's not too much pressure to post.       Setting. Founding this somewhere in the 1970s would make sense. This would place it after the events taking place in The Law of the Sea (1959).

      As a reawakening nation within Europa/Eurth, although not a dead race, perhaps not as focused upon the region about them as they might have been. It has been some time since a visit was conducted within the Haru lands, be it for simple curiosity or ventures of trade and economy. Recent events, a war, a return of the old ways, the acknowledgement of old friends and perhaps old enemies, brings the slumbering beast from its reverie once more. 
      The Occident is in a different state then when the Empress first, and the Emperor that followed, had paid attention to it. A new emperor is about to be crowned, banners once more shall rustle in the breeze. Shall this be more of the same, or a different approach to the realm as it knows.
